In the condition of problem credit, bank creditors will find solutions internally. If the solution is unsuccessful, then the credit can be declared stuck or bad. In this case, bank creditors must take action to regain their money by submitting demands against the debtor through the District Court. Before the issuance of Government Regulation Number 33 of 2006, efforts to collect bad credit were carried out by the State Receivable Affairs Committee (PUPN). However, after the issuance of the regulation, the handling of state receivables is carried out based on legal regulations relating to cooperation and State-Owned Enterprises (BUMN) and its execution regulations.

If not through a lawsuit, the procedure follows the following steps: summons, confiscation, auction notification, and sales through auction.

This change in regulation reflects the government's efforts to provide better legal certainty for banks and debtors, while increasing efficiency in the settlement of state receivables. With a clear understanding of the process of executing mortgage rights and applicable regulations, it is hoped that both parties can work together to achieve a more profitable settlement.
